Terms of Use
The rules for using the TipSense app and website, including the VIP subscription. This is also the app's end-user licence agreement (EULA).
Last updated:
In short: TipSense publishes sports predictions for adults, for information and entertainment only. We don't take bets, don't link to bookmakers and can't guarantee any result. VIP is an auto-renewing subscription billed by Apple or Google; you can cancel it at any time in your store account. Please don't share or resell VIP tips.
1. About these terms
These Terms of Use (the “Terms”) are an agreement between you and Dimitar Shopovski, North Macedonia, who develops and runs TipSense (“TipSense”, “we”, “us”). They apply to the TipSense mobile apps for iOS and Android (the “App”), the website at tipsense.app and everything we publish through them (together, the “Service”).
By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use TipSense
- You must be at least 18 years old, or the minimum legal age for gambling where you live if that is higher. The App asks you to confirm this on first launch.
- Sports betting is restricted or illegal in some countries and regions. You are responsible for making sure that using the Service and placing any bet is legal where you are. The App is not offered in every country.
- Don't use the Service if you have excluded yourself from gambling, or if betting is causing you problems. Our responsible gambling page lists free help.
3. What TipSense is — and is not
TipSense publishes sports analysis and predictions (“tips”) for football, tennis and basketball, together with a public record of how those tips turned out.
- We are not a bookmaker. We don't accept bets, hold money or pay out winnings.
- We are not affiliated with any bookmaker or betting operator, don't link to them and aren't paid by them.
- Odds shown with a tip are the reference price we used when the tip was published. They are not an offer and prices at bookmakers may be different or no longer available.
- Nothing in the Service is an invitation or encouragement to gamble.
4. No guarantees, no advice
Tips are the opinions of our tipsters, based on their own research. Sport is unpredictable: even well-reasoned tips lose, and long losing runs happen. Past results do not guarantee future results.
The Service is not financial, investment or professional advice. If you decide to bet, the decision, the stake and any loss are entirely yours. Only ever bet money you can afford to lose.
5. How tips and the track record work
- Every tip is timestamped when it is published and locked when the event starts. Locked tips can't be edited or removed.
- Results are settled after the event (won, lost, void or push) and stay in the public track record. Profit is shown in units — a unit is a notional stake, not a recommendation of how much money to bet.
- If we make an obvious mistake (for example a wrong score or a typo in the odds), we may correct it. Corrections are logged.
- We aim to publish tips on the schedule described in the App, but the number and timing of tips depend on the fixtures and on whether our tipsters find a bet they believe in. We don't promise a minimum number of tips.
6. VIP subscription
Free tips and the full track record are available without paying. VIP is an optional subscription that unlocks VIP tips while it is active.
- Billing. VIP is sold as an in-app purchase through the Apple App Store or Google Play and is charged to your store account when you confirm the purchase. The price, currency and billing period (for example weekly or monthly) are shown in the App before you buy and may vary by country.
- Auto-renewal. The subscription renews automatically at the end of each period, at the then current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Introductory offers. If an introductory price is offered, it applies to the first period only and to eligible new subscribers as determined by Apple or Google. After it, the subscription renews at the regular price.
- Cancelling. You can cancel at any time in your App Store or Google Play subscription settings (also reachable from Settings → VIP in the App). You keep VIP until the end of the period you already paid for. Deleting the App does not cancel the subscription.
- Refunds. Payments are processed by Apple or Google, so refunds are handled by them under their policies, including any statutory withdrawal rights that apply in your country. We can't issue refunds ourselves. See Support for how to ask.
- Price changes. If the price changes, Apple or Google will tell you in advance and, where required, ask for your consent before charging the new price.
- New device or reinstall. Use “Restore purchases” in Settings to reconnect an active subscription.
- What VIP includes is described in the App. We may improve or change the VIP content (for example the sports or number of tips covered), but won't materially reduce it during a period you already paid for.
7. Your licence and fair use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control and to view the Service for your own personal, non-commercial use, in line with these Terms and the rules of the store you downloaded the App from.
You agree not to:
- share, publish, sell or otherwise distribute VIP tips or their analysis (for example in groups, channels or other tipping services) — whether free or paid;
- scrape, copy in bulk or systematically collect content from the Service, or use it to train other services;
- decompile, reverse engineer or modify the App, or get around its security, its subscription checks or its age confirmation, except where the law allows this;
- use the Service unlawfully, to harm others, or in a way that disrupts it or overloads our systems.
If you break these rules we may suspend or end your access, including VIP access, without a refund.
8. Intellectual property
The App, the website, the TipSense name and logo, and all tips, analysis, statistics and other content we publish belong to us or our licensors and are protected by law. These Terms don't give you any rights in them except the limited licence in section 7. Team and competition names are used only to identify events and belong to their owners. TipSense is not endorsed by any league, club or player.
Open-source software used in the App is licensed under its own terms, listed in the App (Settings → Open-source licences).
9. Changes and availability
We keep improving the Service and may add, change or remove features. We try to keep it available at all times but can't promise it will be uninterrupted or error-free — for example during maintenance, outages of our service providers, or when fixtures change. If we ever stop running TipSense, we will stop selling VIP and tell subscribers in advance where we can.
10. Ending your use
You can stop using the Service at any time by deleting the App (remember to cancel VIP in your store account). We may suspend or end your access if you seriously or repeatedly break these Terms, or if we are required to by law. Sections that by their nature should continue (for example 8, 11, 12 and 15) continue to apply.
11. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises about the accuracy, completeness or outcome of any tip, statistic or other content, or that the Service will meet your expectations. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.
12. Limitation of liability
We are not liable for any money you win or lose by betting, or for decisions you make based on the Service. To the extent the law allows, we are also not liable for indirect or consequential loss, and our total liability to you for any claim related to the Service is limited to the amount you paid for VIP in the 12 months before the claim.
We do not exclude or limit liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules.
13. Apple App Store terms
If you downloaded the App from the Apple App Store, the following also applies:
- These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Your licence to use the App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (the App may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where available).
- We are solely responsible for providing maintenance and support for the App (see Support). Apple has no obligation to provide any maintenance or support services for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent they are not excluded by these Terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms (for example your mobile carrier's) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about the App should be sent to us — see Contact.
14. Google Play terms
If you downloaded the App from Google Play, your purchase and use of the App are also subject to the Google Play Terms of Service. Google is not responsible for the App or its content. If these Terms conflict with the Google Play Terms of Service regarding your relationship with Google, Google's terms apply to that relationship.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of North Macedonia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country or of North Macedonia.
If you have a problem, please contact us first at support@tipsense.app — most issues can be sorted out quickly that way.
16. Changes to these terms
We may update these Terms, for example when we add features or when the law changes. The date at the top shows the latest version. If a change materially affects you, we will tell you in the App or on this page before it takes effect. If you keep using the Service after a change takes effect, the new Terms apply; if you don't agree, stop using the Service and cancel VIP.
